The Whitehouse has released memo’s citing the use of water boarding on captured terrorists. Specifically the two terrorists that are making headlines are Khalid Sheik Mohammed and Abu Zubaydah. Just as a little background Mohammed was designated by the 9/11 comission as the primary architect of the terrorist attacks on September 11th. Abu Zubaydah has ties to Al Qaida and played a lead role in the 2002 millennium attacks. The released documents claims both were water boarded dozens of times.

Water boarding is now classified as an unauthorized torture technique and the Obama administration has said it will not seek prosecution of CIA operatives who performed the water boarding. Of course they would pat themselves on the back for showing such wisdom in not prosecuting the operatives. If they did pursue such legal actions, it would send a clear message to intelligent officers that their actions would subjugate them to criminal prosecution based on the whims of the current administration. This would deal a crushing moral blow to those who protect this great country. Who would want to follow orders from a current administration knowing that the proceeding administration could prosecute them for it. The Whitehouse would like to be praised for its wisdom in not seeking prosecution, but for those who are more aware of the constitution know that such precautions have already been taken care of.

Article 1, Section 10 of the constitution protects citizens from being prosecuted for a an action before the action was classified as a crime. Effectively, since the techniques were applied before they were classified as unauthorized torture, they broke no law. This Ex Post Facto Law would make any Whitehouse attempt to prosecute CIA operatives who performed water boarding unconstitutional. Of course they would not want any of their thunder stolen. Consider yourself aware now.
With the Whitehouse acknowledging these acts and releasing the classified memo’s, we have effectively given more fuel to the fire that burns within terrorists. They now have video’s of government officials acknowledging that the United States performs torture to use as propaganda in recruiting. Go us…
